Terms of Service
Please read these Terms of Service ("Terms") carefully before using the Mechanix Onsite platform. By creating an account or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. The Platform
Mechanix Onsite ("Company," "we," "us," "our") operates a technology platform — accessible via website and mobile application — that enables drivers, fleet operators, and equipment operators ("Drivers") to post requests for roadside or onsite vehicle repair, and enables independent mobile mechanics ("Mechanics") to view and respond to those requests (collectively, the "Service").
Mechanix Onsite is a technology dispatch platform only. We are not a roadside assistance company, a towing service, a repair shop, an emergency service, or an employer of mechanics. We do not dispatch emergency responders, tow trucks, or first responders. We do not employ, direct, supervise, or control any Mechanic who uses the Service. All repair work is performed solely by independent contractors who are entirely responsible for the quality, safety, and legality of their work. If you are in an emergency situation, call 911.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
2. User Accounts
2.1 Eligibility
You must be at least 18 years old to create an account. By creating an account, you represent and warrant that you are 18 or older and that all information you provide is accurate, current, and complete.
2.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@mechanixonsite.com if you believe your account has been compromised. We are not liable for any loss resulting from unauthorized use of your account.
2.3 Account Types
We offer two primary account types: Driver accounts and Mechanic accounts. The features, obligations, and restrictions for each are described in Sections 3 and 4 respectively. You may not hold both account types simultaneously under a single account without our express written permission.
2.4 Account Termination
We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, safety concerns, or any other reason at our sole discretion. You may close your account at any time by contacting support. Certain obligations (including payment of outstanding fees) survive termination.
3. Driver Terms
3.1 Posting a Request
Drivers may post a service request by providing their GPS location, vehicle type, and a description of the issue. You agree to provide accurate and complete information. Posting false, misleading, or fraudulent requests is prohibited and may result in immediate account termination.
3.2 One Active Request
Drivers may have only one active service request at a time. Once a request is fulfilled or cancelled, you may post a new one.
3.3 No Guarantee of Response
Posting a request does not guarantee that a Mechanic will accept it. Response times and availability depend entirely on the number and availability of independent Mechanics in your area. Mechanix Onsite makes no guarantee regarding response time, coverage area, or service availability.
3.4 Payment to Mechanics
Payment for services rendered by a Mechanic is arranged directly between you and the Mechanic. Mechanix Onsite is not a party to that transaction, does not set rates, and does not process payments between Drivers and Mechanics. Any disputes regarding payment are solely between you and the Mechanic.
3.5 Vehicle Condition
You are responsible for accurately describing your vehicle's condition and the nature of the issue. Providing inaccurate information that causes a Mechanic to travel to your location unnecessarily may result in account suspension.
3.6 Safety
You are responsible for your personal safety. If you are in a dangerous location (e.g., an active highway lane), move to safety before using the app. Mechanix Onsite is not responsible for personal injury or property damage arising from your situation prior to, during, or after a service request.
4. Mechanic Terms
4.1 Eligibility
To use the platform as a Mechanic, you must: (a) be at least 18 years old; (b) possess all required licenses, certifications, and permits required by applicable law to perform the services you offer; (c) maintain appropriate insurance coverage for your services and equipment; and (d) have legal authorization to work in the jurisdiction where you perform services.
4.2 Accurate Profile
You must accurately represent your qualifications, services offered, and service area. You may not misrepresent your skills, equipment, or experience. We reserve the right to verify any information you provide and to remove or suspend your account if we discover inaccuracies.
4.3 Accepting & Declining Requests
You have full discretion to accept or decline any service request. There is no penalty for declining requests. However, once you accept a request, you are expected to fulfill it. If you accept and subsequently cannot complete the job, you must notify the Driver promptly through the platform so they can seek other assistance. Repeated acceptance cancellations may result in account suspension.
4.4 Quality of Work
You are solely responsible for the quality, safety, and legality of the services you perform. Mechanix Onsite does not supervise, inspect, or guarantee your work. You agree to perform services in a professional and workmanlike manner consistent with applicable industry standards.
4.5 Setting Your Rate
Mechanics set their own service rates. Mechanix Onsite does not set, recommend, or regulate pricing between Mechanics and Drivers. You are solely responsible for collecting payment from Drivers.
4.6 Insurance
You are required to maintain liability insurance sufficient to cover the services you perform. Mechanix Onsite is not responsible for any damage, injury, or loss arising from services you perform or fail to perform.
4.7 Taxes
As an independent contractor, you are solely responsible for reporting and paying all applicable federal, state, and local taxes on income earned through the platform. Mechanix Onsite will not withhold taxes on your behalf.
5. Independent Contractor Status
Mechanics who use the Mechanix Onsite platform are independent contractors, not employees, agents, partners, or joint venturers of Mechanix Onsite. Nothing in these Terms creates an employment, agency, partnership, or franchise relationship between Mechanix Onsite and any Mechanic.
As an independent contractor, you:
- Control the manner, means, and timing of your work
- Are free to work for other companies and clients, including competitors
- Are not entitled to employee benefits, workers' compensation, or unemployment insurance from Mechanix Onsite
- Are responsible for your own tools, equipment, and transportation
- Are solely responsible for compliance with all applicable laws and regulations in your jurisdiction
If any court or regulatory authority determines that a Mechanic is an employee of Mechanix Onsite, the Mechanic agrees to indemnify and hold harmless Mechanix Onsite from any resulting liability, penalties, taxes, or costs to the fullest extent permitted by law.
6. Subscription & Payments
6.1 Current Pricing
The platform is currently free for all users — both Drivers and Mechanics — during our launch phase. No payment is required to post requests or access job listings at this time.
6.2 Future Pro Plan
We intend to introduce a paid Pro subscription tier for Mechanics with advanced features. Before implementing any paid tier, we will provide at least 30 days' advance notice to existing Mechanic accounts by email and in-app notification. You will never be automatically charged without your affirmative consent to a paid plan.
6.3 If a Paid Plan Is Introduced
When a paid subscription becomes available, the following terms will apply: (a) subscription fees will be charged on a recurring basis (monthly or annually, as selected); (b) subscriptions renew automatically unless cancelled before the renewal date; (c) all fees are non-refundable except as required by applicable law or as expressly stated in our refund policy at that time; (d) we reserve the right to change pricing with at least 30 days' notice; and (e) cancellation takes effect at the end of the current billing period.
6.4 Payment Processing
Any subscription payments will be processed by a third-party payment processor. By providing payment information, you authorize us to charge the applicable fees. We do not store full payment card details.
6.5 Driver-Mechanic Payments
Payments for services between Drivers and Mechanics are entirely separate from any platform subscription and are handled directly between those parties. Mechanix Onsite is not responsible for collecting, processing, or guaranteeing any payment between a Driver and a Mechanic.
7. Location Services
By using the Service, you consent to the collection and use of your real-time GPS location as described in our Privacy Policy. Location data is necessary for the platform to function. You understand and agree that:
- Your location will be shared with other users as necessary to facilitate a service request (as described in the Privacy Policy)
- Disabling location permissions will prevent you from using core features of the Service
- You will not spoof, falsify, or manipulate your GPS location while using the Service
- Location tracking by Mechanix Onsite occurs only during active use of the application
8. Ratings & Reviews
8.1 Ratings System
After a completed service request, users may have the ability to rate and review the other party. Ratings contribute to a public reputation score visible within the platform.
8.2 Honest Reviews
You agree to provide honest, accurate, and good-faith reviews based on your actual experience. You may not post false reviews, defamatory statements, or reviews intended to manipulate ratings. We reserve the right to remove reviews that violate these guidelines or our content policies.
8.3 Effect on Account
Mechanix Onsite may use ratings data to make decisions about platform access, visibility, or account status. We reserve the right to suspend or remove accounts with persistently low ratings or reviews indicating safety concerns or fraudulent behavior.
8.4 No Retaliation
You may not threaten, coerce, or retaliate against another user in connection with a rating or review. Any such behavior is grounds for immediate account termination.
9. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation
- Post false, misleading, or fraudulent service requests or profile information
- Harass, threaten, or abuse any other user
- Attempt to circumvent, disable, or interfere with any security features or access controls
- Use automated scripts, bots, or scrapers to access or collect data from the Service
- Reverse engineer, decompile, or attempt to extract source code from the platform
- Use the platform to solicit Drivers or Mechanics to use competing services
- Spoof GPS location data
- Share your account credentials with others
- Engage in price manipulation, collusion, or any anti-competitive conduct
- Use the Service to transport, process, or facilitate illegal goods or activities
- Perform services while impaired by alcohol, drugs, or medications that affect your ability to work safely
Violation of this section may result in immediate account termination and, where applicable, referral to law enforcement.
10. Intellectual Property
All content, software, trademarks, logos, and other materials on the Service are the property of Mechanix Onsite or our licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any part of the Service without our express written permission.
By submitting content (including reviews, photos, or descriptions) to the Service, you grant Mechanix Onsite a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content in connection with operating and promoting the Service.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.
Mechanix Onsite does not warrant that:
- The Service will be available at any particular time or in any particular location
- Any Mechanic who accepts a request is qualified, licensed, insured, or competent
- Services performed by Mechanics will be free from defects or errors
- The Service will meet your specific requirements
- Any defects in the Service will be corrected
You use the Service and any Mechanic's services entirely at your own risk.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MECHANIX ONSITE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO: LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, VEHICLE DAMAGE, PERSONAL INJURY, PROPERTY DAMAGE, COST OF SUBSTITUTE SERVICES, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO MECHANIX ONSITE IN THE SIX MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability will be limited to the fullest extent permitted by law.
Important: Mechanix Onsite is not liable for the actions, omissions, or negligence of any Mechanic or Driver using the platform. All disputes regarding the quality of repair services, payment, or conduct during a service engagement are between the Driver and the Mechanic directly.
13. Indemnification
You agree to defend, indemnify, and hold harmless Mechanix Onsite and its officers, directors, employees, contractors, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
- Your use of or access to the Service
- Your violation of these Terms
- Your violation of any applicable law, regulation, or third-party right
- Any services you perform as a Mechanic, including injury, death, or property damage
- Any content or information you submit to the Service
- Any dispute between you and another user
We reserve the right to assume exclusive control of the defense of any matter for which you are required to indemnify us, and you agree to cooperate with that defense.
14. Dispute Resolution & Arbitration
14.1 Informal Resolution First
Before initiating any formal dispute, you agree to contact us at support@mechanixonsite.com and attempt to resolve the issue informally. We will make reasonable efforts to resolve disputes within 30 days of receiving notice.
14.2 Binding Arbitration
If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service (including disputes about their validity or applicability) shall be resolved by binding individual arbitration, not in court. The arbitration shall be conducted by JAMS under its Streamlined Arbitration Rules, or another mutually agreed arbitration service. The arbitrator's decision shall be final and binding, subject to limited review as permitted by the Federal Arbitration Act.
14.3 Class Action Waiver
YOU AND MECHANIX ONSITE EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. All disputes must be brought in your individual capacity and not as a plaintiff or class member in any purported class action.
14.4 Exceptions
Notwithstanding the above, either party may bring an individual action in small claims court. Mechanix Onsite may seek emergency injunctive relief in any court of competent jurisdiction to prevent irreparable harm.
14.5 Opt-Out
You may opt out of binding arbitration by notifying us in writing at legal@mechanixonsite.com within 30 days of first accepting these Terms. Your notice must include your name, email, and a clear statement that you opt out of arbitration. Opting out does not affect any other provision of these Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Subject to the arbitration provisions above, you and Mechanix Onsite consent to the exclusive jurisdiction of the state and federal courts located in Colorado for any disputes not subject to arbitration.
16. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you at least 14 days in advance via email or in-app notification and update the "Last Updated" date above. If you continue to use the Service after the effective date of revised Terms, you are deemed to have accepted them. If you do not agree to the revised Terms, you must stop using the Service and close your account.
